On 11 March 2024, the Procurement Act 2023 (Commencement No 2) Regulations 2024 (SI 2024/361) (regulations) were made by the government under powers conferred by section 127(2) of the Procurement Act 2023 (PA 2023).
The regulations brought into force specified provisions of the PA 2023 on 12 March 2024. These include:
• Parts of section 3 concerning public contracts.
• Section 6, concerning utilities contracts.
• Section 9, concerning light touch contracts.
The regulations also brought into force Schedules 1 and 2, concerning threshold amounts and exempted contracts respectively. Some of the other provisions brought into force by the regulations include further regulation-making powers conferred on the government including section 97 concerning information relating to procurement.
