 These proceedings are concerned with a procurement challenge arising out of the Competition for the Fourth Licence to run the National Lottery. 

In summary: The sub-contractor of an unsuccessful bidder in a public procurement process had no standing under the Concession Contracts Regulations 2016 to challenge the award of the contract to the successful bidder or to seek damages. Somebody who had not made a bid would not have standing unless they could show that, but for some discriminatory provision within the invitation to tender, they would have made a bid.
