The Procurement Act 2023 (Commencement No. 1 and Saving Provision) Regulations 2024


On 16 January 2024, the Procurement Act 2023 (Commencement No 1 and Saving Provision) Regulations 2024 (SI 2024/61) were made. The Regulations bring into force a number of provisions of the Procurement Act 2023 (PA 2023).

The Regulations:

•           Brought into force on 19 January 2024 a number of paragraphs of Schedule 10 to the PA 2023 concerning amendments to the Defence Reform Act 2014, which regulates single source defence contracts (paragraphs 1 (partially)-12, 13(1) and (2), 15-17 and 20). Section 117 was also brought into force to the extent that it related to the prescribed paragraphs of Schedule 10.

•           Will bring into force on 1 April 2024 a series of further provisions of Schedule 10 to the PA 2023 (paragraphs 1 (partially), 18 and 19). Section 117 will also be brought into force to the extent that it relates to the paragraphs 1, 18 and 19 of Schedule 10.

•           Confirm that the Single Source Contract Regulations 2014 (SI 2014/3337) (SSCR 2014) remain in force and continue to have effect until they are amended or revoked. This is despite the provisions listed above coming into force on 19 January 2024 amending the powers under which the SSCR 2014 are made.
